This Privacy Notice for Utah Residents (“Notice”) supplements the information contained in the Optimum Outcomes, Inc.’s (“OOI”) general Privacy Policy (available on our website) and applies solely to consumers who reside in the State of Utah (“consumers” or “you”). This Notice is intended to describe our online and offline information practices as they relate to your Personal Information and also to describe your rights related to your Personal Information. We adopt this Notice to comply with the Utah Data Privacy Act (UCPA),and its implementing regulations and any terms defined in the UCPA have the same meaning when used in this Notice.
The UCPA applies to certain information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household (“Personal Information”).
However, the UCPA does not apply at all to some specific types of information, like (1) health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”) and the California Confidentiality of Medical Information Act (“CMIA”), or clinical trial data; or (2) Personal Information covered by certain sector-specific privacy laws, including the Fair Credit Reporting Act (“FCRA”), or the Gramm-Leach-Bliley Act (“GLBA”). Accordingly, this Notice does not apply to these types of information. In addition, under the UCPA, Personal Information does not include publicly available information from government records or certain de-identified or aggregated consumer information. In addition,
We only knowingly collect Protected Health Information or “PHI” that is subject to HIPAA, or which otherwise is not included in the UCPA’s definition of Personal Information. Therefore, we do not knowingly collect any Personal Information that is subject to the UCPA. This Notice is therefore only applicable in the unlikely event we have collected information subject to the UCPA.
This Notice also does not apply to any of our Utah Job Candidates or Utah Resident Colleagues. Information about our collection and use of Personal Information for these categories of “consumers” can be found within our Privacy Policy.
In the unlikely event we collected any Personal Information about you in the preceding 12 months that is not exempt from the UCPA, such information would be included in the following categories. PLEASE NOTE: Although we may have inadvertently collected Personal Information from these categories to the extent described below, we would not necessarily have collected all of the specific pieces of Personal Information described within a particular category of Personal Information, or any of them, for any individual consumer:
OOI does not collect credit card numbers through its website. Online credit card payments are processed through a secure link provided by a third-party payment processor, and OOI cannot access your credit card information from that third party.
OOI’s website (www.oocrm.com) does not use cookies.

We only knowingly collect Protected Health Information or “PHI” that is subject to HIPAA and, therefore, exempt from the UCPA, or information that is otherwise not included in the UCPA’s definition of Personal Information. In the unlikely event we collected any Personal Information about you in the last 12 months that is not exempt from the CUCPA, each of the above-listed categories would have been collected from the following categories of sources:
- Directly from a medical facility we provide services to, including for collections purposes.
- Directly from you for purposes of verifying your identity in order to assist you with billing and payment.
We only knowingly collect Protected Health Information or “PHI” that is subject to HIPAA and, therefore, exempt from the UCPA, or information that is otherwise not included in the UCPA’s definition of Personal Information. In the unlikely event we collected any Personal Information about you in the last 12 months that is not exempt from the UCPA, we potentially would have disclosed or used Personal Information from each of the above-listed categories for one or more of the following business purposes, if permitted by applicable law:
- To fulfill or meet the reason for which the information is provided. For example, if you have provided Personal Information to a medical facility we receive accounts from, for a service to be provided, we will use that information for the purpose for which it was provided.
- To carry out our obligations and enforce our rights arising from any contracts entered into between you and a medical facility, or between us and a medical facility we provide services to, including for collections purposes.
- As necessary or appropriate to protect the rights, property, or safety of us, our affiliates, or others.
- To respond to law enforcement requests, and as required by applicable law, court order, or governmental regulations.
- As described to you when collecting your Personal Information or as otherwise set forth in the UCPA.
- To evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Information held by us is among the assets transferred.
In the preceding twelve (12) months, OOI has not sold or shared Personal Information.
OOI does not sell Personal Information or share Personal Information for cross-context behavioral advertising.
The UCPAprovides Utah consumers with specific rights regarding their Personal Information. This section describes your rights and explains how to exercise those rights.
Your Right to Know and Access Specific Pieces of Personal Information (Data Portability Rights)
You have the right to request that we disclose certain information to you about our collection and use of your Personal Information over the past 12 months. Once we receive and confirm your verifiable consumer request, and confirm that we have Personal Information about you that is applicable under the UCPA, we will disclose the following to you unless the information is exempt from the UCPA:
- The categories of Personal Information we collected about you.
- The categories of sources for the Personal Information we collected about you.
- Our business or commercial purpose for collecting, selling, or sharing that Personal Information.
- The categories of third parties with whom we share that Personal Information.
- The specific pieces of Personal Information we collected about you (if requested, also called a data portability request).
- We do not sell any Personal Information, but If we disclosed your Personal Information for a business purpose, a separate list of disclosures for a business purpose, identifying the categories of Personal Information that each category of recipient obtained.
- Complete the transaction for which we collected the Personal Information.
- Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
- Debug products to identify and repair errors that impair existing intended functionality.
- Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
- Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent.
- Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
- Comply with a legal obligation.
- Make other internal and lawful uses of that information that are compatible with the context in which you provided it.
- To the extent the information is PHI, and thus exempt from the CUCPA.
- Provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information or an authorized representative. Authorized representatives may be asked to provide documentation to support their role.
- Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
- We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you.
- Making a verifiable consumer request does not require you to create an account with us.
- We will only use Personal Information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.
- Deny you goods or services.
- Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
- Provide you a different level or quality of goods or services.
- Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.
OOI reserves the right to amend this privacy Notice at our discretion and at any time. When we make changes to this privacy Notice, we will post the updated Notice on the website and update the Notice’s effective date.
